Effective date: 03-11-2026 · Version: 1.0
PLEASE READ THESE TERMS CAREFULLY.
1. Definitions and Interpretation
- 1.1 In these Terms, unless the context requires otherwise:
- (a) “Company”, “StudyMBBS”, “we”, “us”, “our” means STUDYMEDIC ACADEMY PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 (CIN U80902KL2021PTC072089) and includes its successors and permitted assigns.
- (b) “Platform” means the StudyMBBS website(s), mobile and desktop applications, learning management system, sub-domains, social or messaging channels operated by us, and every service, tool, and feature made available through any of them.
- (c) “Content” means all material on or delivered through the Platform, in any form, including videos, live and recorded classes, audio, question banks, questions, answers, explanations, tests, mock examinations, notes, PDFs, e-books, flashcards, images, illustrations, diagrams, mnemonics, slides, transcripts, printed material, software, code, user interface, and the selection, sequence, and arrangement of any of these.
- (d) “User”, “you”, “your” means any person who accesses or uses the Platform in any manner, whether or not registered, and includes the parent or guardian who registers or pays for a Minor.
- (e) “Minor” means a person who has not completed 18 years of age.
- (f) “Account” means the account created on the Platform in a User’s name, identified by the registered mobile number and/or email address.
- (g) “Subscription” means any paid plan, course, package, combination plan, add-on, or item purchased on or through the Platform, with the features, Content scope, and Validity Period described on the Platform at the time of purchase.
- (h) “Validity Period” means the period for which a Subscription is active, computed from the date and time of successful payment.
- (i) “Piracy” has the meaning given in the Anti-Piracy and Unauthorised Download Policy.
- (j) “Policies” means the Privacy Policy, the Refund Policy, the Anti-Piracy and Unauthorised Download Policy, and any other policy, offer terms, or guideline published on the Platform from time to time.
- 1.2 Headings are for convenience only. “Including” and similar words mean “including without limitation”. The singular includes the plural and vice versa. A reference to a statute includes any amendment, re-enactment, or replacement of it and any rules made under it.
- 1.3 Order of precedence: If there is a conflict between these Terms and a Policy, the provision giving greater protection to the Company’s Content prevails; on refunds, the Refund Policy prevails; on personal data, the Privacy Policy prevails.
2. Acceptance and Binding Agreement
- 2.1 These Terms, together with the Policies, form a legally binding agreement between you and the Company. You accept them when you do any of the following, whichever is earliest: tick the acceptance box; click “Sign up”, “Pay”, “Buy”, or a similar button; or access or use any part of the Platform.
- 2.2 These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and are published under Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. They do not require a physical or digital signature. Our system records of your acceptance, including date, time, IP address, device identifier, and version of the Terms accepted, are admissible as evidence of your acceptance.
- 2.3 If you do not agree to any part of these Terms, you must not register, purchase, or use the Platform.
3. Eligibility, Minors, and Registration
- 3.1 The Platform is intended for MBBS students, medical graduates, and persons preparing for NEET-PG, FMGE, NExT, PLAB/UKMLA, USMLE, and similar examinations.
- 3.2 You represent that you are at least 18 years old and competent to contract under the Indian Contract Act, 1872. A Minor may use the Platform only if a parent or lawful guardian registers the Minor, or gives verifiable consent in the manner we specify, and accepts these Terms on the Minor’s behalf. The parent or guardian is jointly and severally liable with the Minor for all obligations under these Terms, including payment, compliance with the Anti-Piracy Policy, and any damages.
- 3.3 You must provide true, accurate, current, and complete information, including your full name, valid mobile number, email address, and, where asked, college, year of study, or registration details, and keep it updated. We may verify any information by OTP, document, or other means. Providing false, incomplete, or another person’s information is a material breach.
- 3.4 Each person may hold only one Account. An Account is personal to the named User and may not be opened, used, or held for another person, a group, a coaching centre, or an institution, except under a separate written institutional licence signed by the Company.
- 3.5 We may refuse, hold, or cancel any registration or purchase, without giving reasons, where required by law or where we reasonably suspect fraud, misuse, Piracy, or a prior breach of these Terms by you or anyone connected with your Account.
4. Subscriptions and Content
- 4.1 The Platform offers free Content and paid Subscriptions, including year-wise MBBS plans, multi-year plans, and combination plans with global pathway Content. The scope, features, and Validity Period of each Subscription are as displayed on the Platform at the time of purchase, and a record of that description forms part of your contract.
- 4.2 A Subscription grants access only to the Content category and Validity Period purchased. The Validity Period starts on successful payment, whether or not you log in, and is not extended for non-use, illness, examination postponement, change of plans, device issues, or any other reason, except at our sole discretion and in writing.
- 4.3 Live sessions are available only on their scheduled dates during the Validity Period. Recordings are made available where technically and contractually possible and are not guaranteed.
- 4.4 Updates: Medical knowledge, curricula, and examination patterns change. We may update, revise, re-sequence, replace, or remove any Content, faculty member, feature, or format at any time, provided the overall scope of a paid Subscription is not Materially Reduced. “Materially Reduced” means the withdrawal, without reasonable replacement, of more than 50% of the Content hours or question-bank items that formed part of the Subscription on the date of purchase. A change of faculty, platform, format, sequence, or examination-pattern alignment is not a Material Reduction.
- 4.5 Upgrades and renewals: You may upgrade to a higher plan by paying the price difference displayed at the time. Downgrades, plan swaps, transfers between Users, and conversions to another examination are not permitted. Renewals and extensions are at the price then in force.
- 4.6 Expiry: On expiry or termination of a Subscription, access to all associated Content ceases automatically. We are not obliged to retain your progress data, notes, or test history from expiry.
5. Pricing, Payment, and Taxes
- 5.1 Prices are in Indian Rupees and, unless expressly stated otherwise, exclusive of GST, which is charged at the applicable rate and shown separately before you confirm payment. Any change in the rate of tax after purchase does not affect a Subscription already paid for.
- 5.2 Prices, offers, and discounts may change at any time without notice. A change does not affect a Subscription already paid for, and you are not entitled to any refund or credit because a lower price or better offer is later made available.
- 5.3 Payments are processed through third-party payment gateways, app-store billing (Google Play or Apple App Store), or authorised EMI or financing partners. We do not store full card or bank details. We are not liable for any failure, delay, or error of a payment intermediary, bank, or lender.
- 5.4 Coupons, launch offers, scholarships, referral credits, and other benefits are subject to their own published conditions, are personal and non-transferable, cannot be combined unless stated, have no cash value, and may be withdrawn or reversed if obtained by misuse, multiple accounts, or fraud.
- 5.5 No auto-debit without consent: We do not auto-renew a Subscription or auto-debit any amount unless you expressly opt in at checkout. If you opt in, you may switch off auto-renewal at any time from Account > Subscriptions in not more than two steps, and the change takes effect from the next billing date.
- 5.6 A GST-compliant tax invoice is issued for every paid transaction and is available in your Account. A refund, where allowed, is accompanied by a credit note as required under GST law.
- 5.7 Chargebacks: If you raise a chargeback or payment dispute without first using our grievance and refund process, we may suspend the Account until it is resolved. A chargeback that is found to be unfounded, or raised after Content has been accessed, is a material breach, and we may terminate the Account and recover the amount with costs.
6. Account Security, Devices, and Access Controls
- 6.1 You are solely responsible for keeping your login credentials and OTPs confidential and for every act done through your Account, whether or not authorised by you. Any access through your Account is deemed to be access by you.
- 6.2 You must notify us immediately at info@studymedicug.com or +91 81380 01236 of any loss of credentials or unauthorised use. Until we receive notice, you remain liable for all use of the Account.
- 6.3 An Account may be logged in on not more than two Devices, and only one session may stream Content at any time. Changes of Devices are limited to two in each period of 12 months; no further changes can be made.
- 6.4 The Platform may not be accessed through rooted, jailbroken, or emulated devices, virtual machines, remote-desktop tools, screen-mirroring or casting (except features we expressly provide), VPNs or proxies used to mask identity or location, or any software that captures, records, or intercepts Content. We may block such access without notice.
- 6.5 You consent to our use of device identifiers, IP address, login patterns, concurrent-session checks, visible and invisible (forensic) watermarks carrying your Account identifiers, screen-capture blocking, and similar technical protection measures, for the purposes of Account security and detecting and proving Piracy. You must not remove, disable, obscure, or circumvent any such measure.
- 6.6 If we detect or reasonably suspect sharing, concurrent use from different locations, or any act described in the Anti-Piracy and Unauthorised Download Policy, we may immediately log out all sessions, restrict the Account to one device, require re-verification, or suspend or terminate the Account, in each case without refund.
7. Intellectual Property and Limited Licence
- 7.1 All Content, and all copyright, trade marks (including StudyMBBS® and associated logos), designs, database rights, confidential information, and other intellectual property in it and in the Platform, are owned by or licensed to the Company and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Information Technology Act, 2000, and other applicable laws. Each video, question, explanation, note, and image is a separately protected work, and the question bank is also protected as a compilation.
- 7.2 Subject to your continuing compliance with these Terms and payment of applicable fees, the Company grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and view the Content, on the devices permitted under Clause 6.3, through the Platform only, during the Validity Period, solely for your own personal and non-commercial study.
- 7.3 Nothing is sold to you. All rights not expressly granted are reserved. Any use not expressly permitted by Clause 7.2, including any act described in Clause 8 or the Anti-Piracy and Unauthorised Download Policy, is outside the licence and infringes the Company’s rights.
- 7.4 No downloads: Content is made available for online streaming and viewing within the Platform only. No Content may be downloaded, saved, stored offline, printed, or exported from the Platform, in any form or by any means, and the Platform does not provide any download feature to Users.
- 7.5 Printed notes and physical material supplied to you are licensed for your personal study only. Ownership of the physical copy does not permit scanning, photographing, photocopying, reproducing, renting, reselling, or distributing its contents.
- 7.6 If you send us feedback, suggestions, corrections, or ideas, you assign to the Company all rights in them, and we may use them without restriction or payment.
8. Prohibited Conduct
Without limiting the Anti-Piracy and Unauthorised Download Policy, you must not, directly or indirectly, or permit or assist any other person to:
- (a) share your login credentials, OTPs, or Account with anyone, or use another person’s Account;
- (b) download, save, store offline, copy, record, screen-record, screenshot, photograph, capture by camera, transcribe, print, or otherwise reproduce any Content, in whole or in part, by any means whatsoever;
- (c) upload, post, forward, share, stream, sell, rent, lend, broadcast, or make available any Content, in whole or in part, on any website, app, cloud drive, social media, Telegram, WhatsApp or other messaging group, torrent, file-sharing service, or physical medium;
- (d) circumvent, disable, remove, obscure, or tamper with any encryption, DRM, watermark, device limit, screen-capture block, access control, or rights management information;
- (e) reverse engineer, decompile, disassemble, decrypt, scrape, crawl, or extract source code, data, or Content, or use any bot, script, extension, AI tool, or automated means to access, copy, or extract Content;
- (f) use any Content or any part of it to train, fine-tune, prompt, or build any artificial-intelligence or machine-learning model or dataset, or to prepare competing material, notes, question banks, courses, or summaries;
- (g) use the Platform or Content for any coaching, tutoring, institutional, group, or commercial purpose, including teaching from it to others for a fee or otherwise;
- (h) create multiple Accounts, or misuse referral, coupon, or trial schemes;
- (i) probe, scan, or test the vulnerability of the Platform, or interfere with its servers, networks, or security, without our prior written consent;
- (j) post or transmit, in any forum, chat, doubt section, or live session, anything that is unlawful, defamatory, obscene, harassing, misleading, infringing, promotes a competing service, or that solicits other Users;
- (k) impersonate any person, including any faculty member or employee of the Company, or misrepresent your affiliation with us;
- (l) collect, harvest, or misuse the personal data of other Users or faculty;
- (m) make any statement, post, or review about the Company or its Content that you know to be false; or
- (n) attempt, abet, conspire, or agree to do any of the above.
9. User Content
- 9.1 Questions, comments, doubts, reviews, and other material you submit (“User Content”) remain yours, but you grant the Company a worldwide, royalty-free, perpetual, irrevocable, transferable, and sub-licensable licence to use, host, store, reproduce, modify, adapt, and display it in connection with the Platform and its services. Testimonials naming you will be published only with your consent.
- 9.2 You warrant that your User Content is your own, is lawful, and does not infringe any third-party right. We may review, refuse, or remove any User Content without notice.
10. Academic and Medical Disclaimer
- 10.1 The Platform is a supplementary learning resource. It does not replace the curriculum prescribed by the National Medical Commission or your university, or clinical training.
- 10.2 Content is prepared with reasonable care by qualified faculty, but is provided for educational purposes only. It is not medical advice and must not be relied on for the diagnosis, treatment, or management of any patient. We do not warrant that Content is complete, error-free, or current at every point in time.
- 10.3 No guarantee of results: We do not guarantee, and nothing on the Platform or in any communication from us or our representatives is a promise of, any rank, score, pass, admission, licensing, eligibility, placement, or employment outcome. Any results or success stories we publish relate only to the named students and are not an indication of the results you will achieve.
- 10.4 Information about foreign examinations and licensing pathways (including PLAB/UKMLA and USMLE) is general guidance only. Eligibility, fees, syllabi, and rules are set by the relevant foreign bodies, may change, and must be verified by you with those bodies.
- 10.5 No statement by a counsellor, business development executive, faculty member, or other representative binds the Company unless it is set out on the Platform or confirmed in writing by an authorised officer of the Company.
11. Third-Party Services
The Platform may link to or integrate third-party services, including payment gateways, video hosting, app stores, and EMI partners. We do not control and are not responsible for their content, availability, security, or terms, and your dealings with them are solely between you and them.
12. Suspension and Termination
- 12.1 You may stop using the Platform at any time and may request deletion of your Account through Account > Delete account or by email. Deletion ends every active Subscription. Refunds, if any, are governed only by the Refund Policy.
- 12.2 We may, at our discretion and with or without notice, suspend, restrict, or terminate your Account or any Subscription, and refuse any future registration or purchase by you, if:
- (a) you breach these Terms or any Policy;
- (b) you provide false information;
- (c) we reasonably suspect fraud, chargeback abuse, sharing, or Piracy;
- (d) required by law, court order, or a competent authority; or
- (e) your conduct exposes the Company, its faculty, or other Users to legal, reputational, or security risk.
- 12.3 On termination for any of the reasons in Clause 12.2(a) to (c) or (e): no refund, pro-rata or otherwise, is payable; all licences end immediately; and the Company’s rights to claim damages, liquidated damages, and other remedies are preserved.
- 12.4 Clauses 1, 7, 8, 10, 12.3, 13, 14, 16, 17, 19, and the Anti-Piracy and Unauthorised Download Policy survive expiry or termination.
13. Disclaimer of Warranties and Limitation of Liability
- 13.1 Except as expressly stated in these Terms, the Platform and Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, all implied warranties and conditions, including of merchantability, fitness for a particular purpose, and uninterrupted or error-free operation, are excluded. Access may be affected by maintenance, network conditions, device compatibility, or events outside our control.
- 13.2 To the fullest extent permitted by law, the Company, its directors, employees, faculty, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for any loss of data, opportunity, examination attempt, rank, academic year, income, or expected result, however arising.
- 13.3 The Company’s total aggregate liability arising out of or in connection with these Terms, the Platform, or any Subscription, whether in contract, tort (including negligence) or otherwise, shall not exceed the amount actually paid by you to the Company for the specific Subscription giving rise to the claim.
- 13.4 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, or any right you have under the Consumer Protection Act, 2019 that cannot be waived by contract.
14. Indemnity
You (and, for a Minor, the parent or guardian) shall indemnify, defend, and hold harmless the Company, its affiliates, directors, employees, faculty, and agents from and against all claims, demands, losses, damages, penalties, costs, and expenses (including reasonable legal fees and costs of investigation, forensic analysis, and takedown) arising out of or relating to:
- (a) your breach of these Terms or any Policy;

For Minors, we process personal data only with verifiable consent of the parent or guardian, and we do not undertake tracking, behavioural monitoring, or targeted advertising directed at Minors.
- 15.2 You acknowledge that the Company may process Account, device, usage, watermark, and log data to enforce these Terms, to detect, investigate, and prove Piracy, and to establish, exercise, or defend legal claims, and may disclose such data to law-enforcement agencies, courts, regulators, intermediaries (for takedown) and professional advisers for those purposes, as permitted by law.

17. Dispute Resolution
- 17.1 Any dispute shall first be raised with the Grievance Officer under Clause 18. The parties shall attempt to resolve it in good faith within 30 days.

The seat and venue shall be Bengaluru, the language English, and the proceedings may be conducted online. The award shall be final and binding.
- 17.3 Clause 17.2 does not affect:
- (a) a User’s right, as a consumer, to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019; or

19. Amendments
- 19.1 We may amend these Terms or any Policy at any time. Material changes will be notified on the Platform or by email at least 7 days before they take effect, except where a change is required by law or to address security or Piracy, in which case it may take effect immediately.
- 19.2 No amendment shall reduce the scope or Validity Period of a Subscription already paid for, or apply retrospectively to a breach committed before it takes effect. Your continued use of the Platform after the effective date constitutes acceptance. If you do not accept an amendment, your sole remedy is to stop using the Platform.
20. General
- 20.1 Entire agreement: These Terms and the Policies constitute the entire agreement between you and the Company on their subject and supersede all prior representations, brochures, messages, and statements, whether oral or written.
- 20.2 Severability: If any provision is held invalid or unenforceable, it shall be read down to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.
- 20.3 No waiver: No failure or delay by the Company in exercising any right is a waiver of it, and no single or partial exercise of a right prevents its further exercise.
